How Do You Prove That Your First Time Seizure While Driving Is ‘an Act Of God?’

I had a seizure while driving for the first time ever and rear-ended another car. My insurance is not going to cover her damage and the other party is not giving up. She wants to take me to court. We just don’t know what to do now. I had two more seizures after this accident and spent a night in the hospital. Diagnosed with epilepsy since all other tests were normal. Neurologist said firmly that he wouldn’t sign anything saying I never had seizures before. Primary doctor provided a signed… read more

I was a relatively normal person growing up, once past puberty and Junior High. What no one knew at the time is that I had / have catamenial epilepsy, as well as partial complex seizures. I did learn how to drive in high school and drove successfully in D/FW for years, even on the freeway. No fear. I changed at 13, my first year in Junior High. Lasted not to long and switched to Tegretol for YEARS. Anyway, after the beginning of "being female" and with each pregnancy, the seizures became less controlled and stable, but after hormone surges, I would go pretty much back to previous meds.

After 1987,the neurologist in Los Angeles would not give me clearance to drive and after someone side swiped me with no seizures, they pulled my license. I didn't drive for almost 15 years bc I was too afraid to. I became pre menopausal at somewhere after my 2nd daughter's birth in 1994. I had a VNS put in around 2001 and a lobectomy in December 2002 bc that's when neurosurgeon was available.

I don't recommend this, bc it can do bone damage, but I took Depo-Provera birth control shots for over 10 years, which helped control the seizures. It gave me added testosterone. Don't understand. The seizures should have become better with less estrogen after menopause, but they got worse. Go figure.

When the seizures became worse, after the addition of a soy allergy reaction, I had more cluster/break out seizures than I did before. I gave up driving between 2010 and 2013. My youngest daughter became normal driver got family. But thankfully, nothing ever happened, despite some close calls. Will updatmore later. Too sleepy to continue.

My first question is How long since she had a seizure before she drove? I had take drives Ed 2 times. I did have 3 accidents m. The last one I felt so bad and worried that the people would sue me. The police had told them that I was trying to get off the rd bit the seizure came fast. I had hit 3 cars and a few other things. No one sued me. My husband then, he had passed away, offered to pay for any medical treatments and the people said that they understand what happened. My oldest daughter and I were questioned and the police told the people that we both told the same thing. The bad part was that some of the cops knew my father or had my mother for the art teacher. I had warnings before gran mal even partial ones. Know funny feelings or anything that you realize is different are partcial seizures.

My insurance company paid off my loan for my car, but the other party wants my insurance to pay for her damages. They refused since it was a medical incident.
